Personal data

TROPICAL-CAR SL protects personal data within its technical and personal possibilities.

To guarantee personal rights personal data are collected in the legal frame work of the current General Data Protection Regulation GDPR, REGULATION EU 2016/679. In the focus are principles (GDPR Par. 5) as lawfulness, few data as possible, necessity und purpose, correctness, limitation of storing, transparency, integrity and privacy.

Responsible operator

The responsible operator of TROPICAL-CAR SL and his webmaster are mentioned in the legal notice of this website. Mrs. Tanja Agel is responsible for data protection and the contact person.

Operating purpose

Operating purpose is car rental. The collected data are used only for car rental of TROPICAL-CAR SL and their branches.

Email contact form

Personal contact data voluntary send over the email contact form as name, email address and telephone number are used only for contact. This data are not collected and processed outside the email application. Emails are deleted if not necessary anymore for car rental. The pre-contractual data processing has Par. 6 (1) lit. b GDPR as legal basis.

Purpose of data collection

Purpose of data collection is the operating purpose.

Data collection and legal basis

Pre-contractual booking requests include the contact data name, telephone number, and email address. This booking requests are deleted if no car rental contract is closed.

For the contractual binding booking name, telephone number, email address, date of birth, passport, driver licence, place of residence, telephone number, mobile telephone number and flight details (arrival) are collected. This data belong to the rental contract without them car rental is not possible.

The pre-contractual and contractual data processing has Par. 6 (1) lit. b GDPR as legal basis.

The data are ruled by data protection and are not given to third parties.

Data processing

Booking data are stored and administrated in the applications of TROPICAL-CAR SL at a webhoster without the possibility of third parties to access this data.

Backup data are stored by the webmaster of TROPICAL-CAR SL and the webhoster. Additionally data on booking paper forms are stored at a secure location.

The webhoster stores in the log files of the webserver general access data and information as time of access, IP-address, browser and operation system necessary for the secure operation of the server (e.g. defence of cyber attacks and noncomplying use). This data are neither collected nor used in applications of TROPICAL-CAR SL. Legal basis for temporary storing of data and log files is Par. 6 (1) lit. f GDPR.

Data deletion

Booking data are stored maximum 5 years within the legal retention period, for operating purpose, and claims management. After this booking data are deleted or made anonymous.

Address and contact data of bookings are deleted if after 5 years no booking occurs.

Legal instruction and your rights (GDPR Par. 13)

With the car rental contract hirers are legally instructed including their rights::

Right of deleting of data (GDPR Par. 17), Right of enquiry about data (GDPR Par. 15), Right of update of data (GDPR Par. 16), Right of restriction of data processing (GDPR Par. 18), Right of revoke (GDPR Par. 21), Right of transferable data (GDPR Abs. 20), Right of appeal (GDPR Par. 77).

Cookies

The website TROPICAL-CAR SL uses cookies. Cookies are text files that are stored in a computer system via an Internet browser. Through the use of cookies, users of this website can be provided more user-friendly services that would not be possible without cookie setting.

The website uses within the session a temporary session cookie (expires at the end of session).

Google Analytics (see below) uses permanent cookies. The legal basis of permanent cookies is § 15 Abs. 3 Telemediengesetz (TMG) with hint on the website, that the user agrees to cookies by using the website.

You may prevent the setting of cookies by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs.

Data about web access

The data collected, processed and stored are kept secure and confidential. They are used solely to provide and protect the Google Analytics service and to perform important system operations, in rare cases for legal purposes. There is no data release for third parties and for other purposes by setup for this website. User ID's are not activated.

Collected data about web access are always anonymous (IP-pseudonymized) and are only for the optimisation of our internet offer including statistics. For this we have a legitimate interest according Art. 6 (1) lit. f GDPR. The collection, storing and processing of this anonymous data is done by Google Analytics with cookies. For this we have a data processing agreement with Google.

Google Maps

The site uses Google Maps (API) from Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google"). US-based Google LLC is certified under the us-european "Privacy Shield" agreement, which ensures compliance with the level of data protection in the EU. Google has declared that all Google Service are in conformance with GDPR.

Google Maps is a web service for displaying interactive (land) maps to visually display geographic information.

When you visit any of the subpages where the Google Maps map is incorporated, information about your use of our website (such as your IP address) is transmitted to Google's servers in the United States and stored there. This is done regardless of whether Google provides a user account that you are logged in to, or if there is no user account. When you're logged in to Google, your data will be assigned directly to your account. If you do not wish to be associated with your profile on Google, you must log out before activating the button. Google stores your data (even for non-logged-in users) as usage profiles and evaluates them.

The using is according to Art. 6 (1) lit. a of the GDPR with your consent.
